El derecho al olvido, su ideal regulación en México

Abstract

La presente entrega aterriza la vanguardista temática de “El Derecho al Olvido” mientras que proyecta su ideal aplicación en México. Para esto, se han tomado como cimientos jurídicos la normativa europea “GDPR” y la no tan novedosa “Directiva 95/46/CE”. En primer orden, se hace un recuento de los antecedentes que han contribuido a la creación de “El Derecho al Olvido”, a continuación se analizan las sentencias internacionales más relevantes en el tema, las cuales han sido una pieza clave para comprender la importancia de su regulación y la vulnerabilidad de nuestra intimidad y, finalmente, se propone el método para la implementación de la regulación de “El Derecho al Olvido” en México.

Th e presented work focuses on the progressive issue of “Th e right to be forgotten” and its potential application in Mexico. Th e juridical foundations taken are the European normative “Directive 95/46/CE” and the fairly new “GDPR”. Th e fi rst section is a recall of the events that led to the creation of “Th e right to be forgotten”. Th ere follows an analysis of the most relevant international sentences to this issue, which have been key to the comprehension of the importance of its regulation and the vulnerability of our intimacy. Finally, a proposal is presented of the method that should be followed to implement the regulation of the “Right to be forgotten” in México.
