El medio ambiente y los derechos humanos: su concepción constitucional

Abstract

El estudio del Derecho Ecológico conforma una realidad científica indiscutible, situación que nos obliga a reflexionar sobre el objeto real de la ecología. El estudio del medio ambiente no trata únicamente de cuestiones relacionadas con aspectos biológicos, químicos o médicos, la ecología, debido a su relación íntima con el origen y el futuro del género humano en cuanto tal, supone un nuevo dilema, es decir, una reconcepción de la manera en que los seres humanos organizan sus relaciones entre sí, con la naturaleza y con su sentido del universo. Por esto, el Derecho Ecológico como parte del orden jurídico normativo del Estado mexicano, regulador de las relaciones sociales, políticas y económicas dentro del mismo y protector del desarrollo y consecución de los valores y finalidades contenidas en la Constitución Política, se presenta, en su relación con esta última, en una posición jerárquica y real compleja y difusa, lo cual abre las puertas para la investigación científica y su derivada aportación para la comprensión de dicho dilema técnico y filosófico, el cual constituye, hoy en día, una realidad innegable y una prioridad ineludible.The study of Ecology Law conforms an indisputable scientific reality, issue that originates a reflection on the real object of ecology. The study of the natural environment is not solely related to biological, chemical, or medical aspects. Ecology, as intimately related to the origin and future of human race as such, supposes a new dilemma, that is to say, a new conception on the way human beings organize their relationships among them, with nature and with their sense of the universe. That is why Ecology Law, as part of the normative Mexican legal system, as a regulator of social, political, and economical relationships within the Mexican State, and as protector of the development and achievements of the values and purposes contained in the Political Constitution, is presented, in its relationship with the Constitution, in a real and hierarchical relationship, complex and diffuse. This opens the doors to scientific research and its derived contribution for the understanding of such technical and philosophical dilemma, which currently constitutes an undeniable reality and an unavoidable priority.
