Aristóteles autor de la teoría de la división de poderes (Opinión)

Abstract

Aristóteles al estructurar una teoría de la división del poder lo hace a través de un análisis descriptivo jurídico-filosófico de los gobiernos existentes en la Grecia de su época. Los mismos tres poderes que todos sabemos, Aristóteles distingue muy puntualmente, con la diferencia verbal de llamar ‘deliberante’ al poder legislativo y ‘magistratura’ a los órganos del poder ejecutivo. No es más que una injusticia histórica, que es ya tiempo de reparar, el haber adjudicado a Montesquieu la originalidad de una teoría que pertenece por entero a Aristóteles. / Aristotle made a separation of powers theory through a legal-philosophical descriptive analysis of the existing governments in the Greece of his time. Aristotle distinguishes the same three powers that all we know very precisely, with the verbal difference of calling “deliberative” to the legislative power and “magistrates” to the authorities of the executive power. It is not more than an historical injustice that already is time to repair, to adjudge to Montesquieu the originality of a theory that belongs entirely to Aristotle.
