Hacia la consolidación del derecho del deporte en México

Abstract

Ante la evolución que ha tenido el Derecho del deporte en los diferentes países del mundo, es necesario revisar el caso de México. Por ello, la presente investigación tiene como objetivo principal proporcionar ciertos elementos que permitan al lector identificar el contenido de dicha disciplina, acentuando con ello su importancia social. Para tales efectos, partiendo de una breve referencia a las concepciones clásica y moderna del Derecho, propias de la tradición jurídica romano–canónica a la que pertenecemos (Sistemas Jurídicos de Europa Occidental y Latinoamérica), se explica lo que es el Deporte, su vinculación con los conceptos de Cultura y Estado. Posteriormente, con los elementos expuestos, se hace referencia al concepto, naturaleza y características del Derecho del deporte en México, fundando y motivando lo relativo a su posible autonomía. Asimismo, se señalan los antecedentes históricos que ha tenido esta rama del Derecho en nuestro país, así como su respectiva Legislación, fijando el concepto de sistema jurídico deportivo y la sistematización que a nuestro parecer le corresponde a dicha disciplina para su justo desarrollo en nuestra realidad.Before the evolution that has been entitled of the Sport Law in the different countries of the world, it is necessary to revise the case of Mexico. For it, the present investigation has as main objective to provide certain elements that allow the reader to identify the content of this discipline, accentuating with it its social importance. For such effects, leaving from a brief reference to the classic and modern conceptions of Law, characteristic of the Civil Law Tradition, to the one that belong (Legal Systems of Western Europe and Latin America), that is explained that is the Sport, their linking with the concepts of Culture and State. Later on, with the exposed elements, reference is made to the concept, nature and characteristic of the Mexican Sport Law, being founded and motivating the relative thing to its possible autonomy. Also, the historical antecedents are pointed out that has had this branch of the Law in our country, as well as their respective Legislation, fixing the meaning of sport juridical system and the systematizing that it corresponds to this discipline for their fair development in our reality.
